The website immomaps.be is owned by IMMOMMAPS NV (BE0764 419 089), whose registered office is located at: Slachthuisstraat 72, 9000 Ghent. RPR Ghent, Department Ghent.

The use of immomaps.be implies that you accept ImmoMaps terms of use in full and irrevocably.

The website is exclusively intended for the publication of real estate properties for sale or long-term rental.

The terms of use, the privacy policy and the cookie policy together form the complete agreement between the user and ImmoMaps.

ImmoMaps reserves the right to change the terms of use at any time. As well as to temporarily or permanently stop the platform, and this with or without prior notice, without any form of compensation.

Content on immomaps.be

ImmoMaps is not responsible for the content posted by users on the platform.

Each user of ImmoMaps declares and accepts that ImmoMaps has the right to use and publish any content (or part of it) that a user post on immomaps.be.

Each user declares not to publish misleading information or intellectual property rights. Also not to violate the rights of third parties.

ImmoMaps is granted a license on the posted content of a user to allow ImmoMaps to use, publish and reproduce the content.

Each user is responsible for his own login details and password.

Publications of ImmoMaps users

ImmoMaps has the right to remove all or part of the publications or to make adjustments that do not meet reasonable quality criteria, without any form of compensation.

ImmoMaps can remove, modify or offline all or part of the following publications:

• Multiple publications/spam by the same user for the same property.
• Publications with links to other websites.
• Publications with blurry photos/photos with people/photos with watermarks.
• Publications outside the Belgian area or errors related to the location.
• Publications with inappropriate/misleading descriptive text.
• Publications that have already been rented or sold.
• Publications that infringe the intellectual property rights of third parties. (A user must be the owner or must have permission to place a publication on ImmoMaps.)
• Publications that damage the reputation of ImmoMaps.
• False publications.
• Publications that give rise to discrimination.
• Old publications. (After 2 years a publication will automatically be placed offline.)
• Publications other than real estate.

Account creation

Immomaps.be users can register freely on the ImmoMaps portal. Users who sign up agree to ImmoMaps privacy policy and will have access to the following free features:

• Saving favorite listings.
• Saving searches.
• Enable email notifications for new listings within saved searches.
• Contact advertisers.
• Your office at “Find a realtor”, “Find a notary” or “Find a property developer” (only for professional users).
• Receive newsletters.

Every professional user, i.e. real estate agents, property developers, notaries and other real estate professionals agree that ImmoMaps will share a single tagged welcome message with the logo of the new professional user on his social media (Facebook, Instagram and/or Linkedin).

Accounts of ImmoMaps users

ImmoMaps has the right to remove users or to make modifications to their account that do not comply with the terms of use or do not respect the terms of use, without any form of compensation.

ImmoMaps can remove, reject, modify or deactivate all or part of the following accounts:

• Accounts with inappropriate and/or misleading text and/or logo.
• Users who do not respect the terms of use.
• Users who use the personal data of other users to offer products or services.
• Accounts of real estate professionals who are not real estate professionals.

Professional users (realtors, property developers, notaries and other real estate professionals) agree that their commercial data will be placed publicly on ImmoMaps.

Limitation of Liability

ImmoMaps cannot be held liable for:

• Content posted by ImmoMaps users.
• Failure to comply with the legal obligation to provide information when publishing your real estate advertisements.
• The unavailability of the ImmoMaps platform. ImmoMaps reserves the right to interrupt access to the platform at any time and without prior notice. As well as permanently interrupting the platform and our services, without ImmoMaps being held responsible for damages to you or to third parties.
• Damage or defects to users' data or equipment through the use of the platform.
• Viruses transmitted by the use of the ImmoMaps platform.
• ImmoMaps cannot be held responsible for any errors, incompleteness of the content and/or the availability of a publication. (Publications on ImmoMaps do not constitute an offer, but a request to contact the provider.)
• For any form of damage resulting from a contact resulting from the offers of an immomaps user.
• For misuse of a user's credentials by third parties.

ImmoMaps takes all reasonable measures to ensure that the portal is operational and free of bugs. Failure, interruption or errors in the electronic supply cannot result in reimbursement, price adjustments or other compensation, unless in the event of intentional errors by IMMOMAPS NV.

Notifications by ImmoMaps

As a user of ImmoMaps you agree that ImmoMaps can contact you by e-mail, cell number, telephone, WhatsApp, messenger, postal address or via a notification on the website.

Intellectual rights

The texts, code, buttons, layout, design, drawings, photos, videos, images, data, databases, software, names, trade and domain names, brands, logos and other components of the platform are protected by intellectual property rights and belong to ImmoMaps or to third parties. Violation of these rights results in severe penalties. The use of the content or any part of it is prohibited.

The database of immomaps is protected by law, the user only has the right to print a copy for personal use of the content while preserving the origin, it is forbidden to store, to reproduce, modify, disclose, distribute or transmit, sell or otherwise transfer or grant any rights thereto to any third party.

ImmoMaps, its logo, icons and trade names are subject to name protection legislation. They cannot be used in conjunction with any other product or service in a way that could potentially confuse or in any way discredit or otherwise prejudice ImmoMaps.

Also, the commercial use of content on ImmoMaps is prohibited.

Payment Terms & Subscriptions

IMMOMAPS NV has the right to require invoices to be paid in advance, and in any case, invoices must be paid within 30 days after the invoice date.

In the event of non-payment, IMMOMMAPS NV has the right to place current publications offline without notice, without IMMOMMAPS NV being liable to owe any compensation for this.

If an invoice is not paid by the due date, by operation of law and without a prior notice of default being required, late payment interest is owed at the interest rate resulting from the Commercial Transactions Payment Arrears Act, calculated on the invoice amount from the invoice date, increased by a fixed compensation of 10% on the total invoice amount, with a minimum of 50 euros.

If ImmoMaps makes price changes to the subscriptions for professional users, all administrators will be notified one month in advance by e-mail.

Cancellation conditions of subscriptions

Professional ImmoMaps users (realtors, construction promoters, notaries & other real estate professionals) can cancel their subscription at any time under the tab “Subscriptions” on the page of the office. The subscription runs from the cancellation until the end of the paid term.

Miscellaneous provisions & applicable law

The invalidity, nullity or unenforceable nature of all or part of any of the above provisions shall not invalidate any other provisions.

Immomaps has the right to report misuse to the competent authorities.

In the event of a dispute arising from the use of the platform, the Belgian law shall apply, and the courts and tribunals of the Ghent area shall have jurisdiction.
